Supreme Court Permits Sonam Wangchuk’s Wife to Expand Plea Against His Detention
Angmo gets a week to file amended petition citing lapses in Ladakh activist’s arrest under NSA New Delhi, Oct 29: The Supreme Court on Wednesday granted permission to Gitanjali Angmo, wife of detained Ladakh-based climate activist Sonam Wangchuk, to submit an amended petition challenging the legality of his detention under the National Security Act (NSA), 1980).
A Bench of Justices Aravind Kumar and N.V. Anjaria gave Angmo one week to file her revised plea, which seeks to highlight alleged procedural violations by authorities during Wangchuk’s arrest.
Appearing through senior advocates Kapil Sibal and Vivek Tankha, Angmo argued that her husband’s detention was based on outdated FIRs filed more than a year ago, in which he was not even named. She also said the grounds of detention were handed over after a 28-day delay, leaving Wangchuk with little time to defend himself before the Advisory Board.
The petition further claims that crucial video evidence cited by authorities was not shared within the legally required timeframe, and that the detention order lacked the independent satisfaction required of the Leh District Magistrate under Section 3 of the NSA.
Representing the Centre, Solicitor General Tushar Mehta was given 10 days to respond with a counter-affidavit. The court has scheduled the next hearing for November 24.
Wangchuk, a noted environmentalist and education reformer, has been in custody since earlier this year following protests in Ladakh, where locals have been demanding constitutional safeguards and greater autonomy under Article 371.
